H-1B签证是签发给受美国公司雇用、有特殊才能或专业的外国人的工作签证，该签证受配额限制，目前签证限额是每年不超过65,000名。

H-1B签证的签发对雇主的行业或申请人的专业范围没有太多限制。任何雇主，无论从事工业生产、农业管理、科学研究还是文化事业，均可按规定雇用符合要求的外国人。而申请人则要求必须具备特殊才能或专业知识而且申请的工作与其背景相符才能受雇。申请人必须具备学士以上的学位，或者相当于学士学位的实际工作经验。

申请条件

申请H-1B签证，必须具备以下五个条件：

1.申请人必须具有大学以上或有相当于大学专业水平工作经验的专业人员；大学专业水平和专业人员具有双重含义，即指在专业学院取得学位后从事相同职业两年以上，如建筑师、律师、医生、工程师、教师、会计、电脑系统分析员、理疗师、化学师、药剂师、医疗技师、酒店经理、高级商业经理等。

2.需要获得符合资格的美国雇主的雇用并在美国境内工作。

3.申请人所获得的工作必须是“专业性”的。申请人即使是具有大学专业学位的专业人员，但如果所获得的工作是非专业的，也不符合要求。

4.申请人的工作背景必须同所获得的工作相符合。

5.提出陈情申请的雇主必须向劳工部申报FTA-9035表，即“劳工情况申请表”并且获准。主要是雇主保证所雇的外籍员工将会同美国工人一样获得平等的待遇。此外，如果雇主提前解雇所雇用的外籍员工，则有义务支付该员工返回其居住国的旅程费，除非该雇员自己提出辞职。

评估文凭

美国并不承认全世界每个国家的大学或学院所颁发的文凭同美国同级大学或学院的文凭具有同等的水准。因此，需要对申请人进行文凭评估。一般来讲，除世界名牌大学被统一认可外，欧洲发达工业国家的文凭容易获得同级认可，其他国家则会按个案处理。如果移民局对某一文凭不熟悉或不认可，则会要求申请人进行文凭评估，尤其是在当文凭对申请案有决定因素时，如果申请入毕业于名牌大学或其居住地公认的一流大学，或者有足够的工作经历背景，其申请一般不会受学历资格的影响，但如果申请人毕业于普通的学院或者是通过进修获得文凭，或者是申请人无法把握自己的学业水平在美国可以获得什么程度的接受，则需要在提出对文凭进行评估。

美国有很多专门从事文凭评估的独立机构。申请人只要提交自己有关文凭的证件或材料，即可获得文凭评估证明，如果证明的结果对申请人有利，则可在申请时附上评估证明。如果评估结果对自己不太有利，申请人则可考虑在申请中不包括评估证明，等移民局要求时再行提交，如果申请人的学历资格不十分有力，同时又没有足够的工作经历背景，建议选择其他类型的签证。

申请程序

如果申请人及其雇主均符合要求，即可考虑提出H-1B签证申请。如果申请人在其居住国家，则应由雇主先向移民局提出陈情申请，获准后，再由申请人持移民局批准件和个人文件向其居住地的美国使领馆申请签证。申请人如果已持其他非移民签证进入美国，则可同时向移民局提出雇用及转换身份申请。但申请人如果持C类过境签证、D类航务人员签证、某些J类交换访问者签证、K类未婚夫（妻）签证以及S类证人签证则不可以在境内转换身份。此外，雇主在提出雇用申请以前，须向劳工部申报“劳工情况申请表”，由劳工部背签后方具备申请资格。

申请人必须亲自赴使领馆申请，而且其材料和面谈均应使领事感到满意，否则签证申请有可能被拒绝，申请人无法进入美国，以前的努力均前功尽弃。如果申请人及雇主的背景非常有力，则以选择在境外签证为好。

需要的文件

1. 雇主向移民局申请需以下文件：

（1）I-129表，即“非移民雇员申请表”

（2）申请人照片

（3）向劳工部申报并获准的“劳工情况申请表”

（4）雇主同申请人签订的雇用合同

（5）雇主所提供的工作属专业性工作的证明

（6）雇主支付工资的能力证明

（7）申请人学历和毕业证书、学位证书、学校成绩单以及工作经历证明

（8）申请费

如果申请人系杰出的时装模特儿，申请材料则免除第（5）项和第（7）项。全套申请材料一式两份，寄往雇主公司所属地区的移民服务中心。

移民局在受理过程中如果要求补充文件，雇主则应按要求补齐材料并在规定的时间内寄回同一移民局。提交给移民局的申请材料如果有非英文的材料，须翻译成英文。

2. 申请人向居住国使领馆申请需要的文件：

（1）0F-156表，即“非移民签证申请表”

（2）I-797批准件原件

（3）护照，如有随行眷属，每人均需提交

（4）照片，如有随行眷属，每人均需提交

（5）家庭关系证明。如果有随行家属，则需提交结婚证书、．子女出生证，如果再婚，则需提么离婚证或配偶死亡证

3. 申请人在美国境内向移民局申请需要提交的材料：

首先，申请人必须：

（1）所持的签证没有转换身份的限制

（2）合法进入美国

（3）没有在美国非法工作记录

（4）其I-94入境记录卡没有过期

4. 申请人转换身份的申请应同雇主的申请同时提交，除照片以外，同前面所述的雇主向移民局申请的材料完全一样，但还应补充：

（1）I-539表，即“非移民身份延期/转换申请表”

（2）I-94入境记录卡，如有随行眷属，每人均需提交

（3）如有随行眷属，则需提交关系证明，如结婚证、子女出生证等

（4）如再婚，则需提交原有婚姻关系证明，如离婚证、配偶死亡证

（5）申请费

（6）如果雇主已向移民局提出申请或者已经获准，则应提交申请的收据或者批准件
